Purchasing & Returns

These terms apply to original artworks purchased from Rodney J. Edwards trading as rodedwards.art, whether purchased through rodedwards.art or arranged directly by email, Instagram/direct message or another method where we do not meet in person before the purchase is agreed.

In these terms, a ‘distance purchase’ simply means a purchase made without us meeting in person before the contract is agreed - for example, through my website, by email or by Instagram, Facebook or direct message (DM).

The artwork

Each artwork offered for sale is an original work unless clearly stated otherwise.

The individual listing, sales page or direct correspondence will identify the artwork being purchased and give its dimensions, materials and price.

I make every reasonable effort to photograph and describe artwork accurately. The appearance of colours may vary slightly between screens and devices. Nothing in these terms affects your statutory rights if an artwork is not as described.

Prices and payment

Prices are shown in pounds sterling.

Standard delivery within my stated delivery area is included in the displayed price unless otherwise stated.

Payment must be made using one of the payment methods offered at checkout or using the secure Stripe payment link supplied for a direct purchase.

For direct sales, the contract is formed when payment has been successfully received and I confirm the purchase.

For purchases made through the website, the contract is formed when you receive the order confirmation following successful payment.

Where I deliver

Short-form sales information may describe standard delivery as ‘mainland UK’. For the purposes of these terms, standard delivery for small original unframed works is available to addresses within the United Kingdom served by Royal Mail Tracked 48.

Standard delivery is included in the displayed price unless otherwise stated.

International orders

Delivery to destinations outside the United Kingdom may be possible by prior arrangement. Please contact me before purchasing. International delivery charges and estimated delivery times will be agreed before purchase. The buyer is responsible for any import duties, taxes or customs charges imposed by the destination country unless otherwise agreed. Customs procedures may also cause delays outside my control.

Dispatch and delivery

Orders for small original unframed works are normally dispatched within 3 working days after successful payment.

For these purposes, working days are Monday to Friday, excluding bank holidays in England and Wales.

Orders and payments received after 4pm are treated as received on the next working day for the purpose of calculating dispatch times.

I do not guarantee same-day or urgent dispatch or delivery unless a particular arrangement has been expressly agreed with you before purchase.

Small original unframed works are normally sent using Royal Mail Tracked 48.

Royal Mail currently aims to deliver Tracked 48 items within 2–3 working days after dispatch for the majority of UK addresses. This is a delivery aim rather than a guaranteed delivery time.

Royal Mail does not provide a delivery target time for Tracked 48 items sent to certain UK postcode areas, and delivery to these destinations may therefore take longer. These currently include:

AB30–38, AB41–45, AB51–56, AB99, BT, DD8–10, DG7–9, FK8, FK15–21, HS, IV, KA27–28, KW1–17, PA20–38, PA41–80, PH10–11, PH13–14, PH17–18, PH19–44, PH49–50, TD15, TR21–25 and ZE.

For larger or framed works, the dispatch time, delivery method and any particular delivery arrangements will be stated on the artwork listing or agreed with you before purchase.

You will receive a dispatch confirmation and tracking details when your artwork has been sent.

Please provide a complete and accurate delivery address and contact me as soon as possible if you discover an error.

If an artwork is returned to me because the delivery address you supplied was incorrect, or because delivery could not be completed and the item was not collected, I may ask you to pay the actual cost of re-delivery if you would like me to send it again. This does not apply where the failed delivery was caused by me or the carrier and does not affect your statutory rights.

If an unforeseen delay means that I cannot deliver within the period agreed with you, I will contact you.

Unless we have agreed a different delivery period, your order will in any event be delivered without undue delay and no later than 30 days after the contract is entered into.

The artwork remains at my risk until it comes into your physical possession, or the possession of a person you have identified to receive it on your behalf.

If, at your request, I hand the artwork to a carrier that you have independently chosen and which I did not offer as a delivery option, risk passes to you when the artwork is handed to that carrier.

Special dispatch and delivery arrangements

If you need an artwork sooner than my normal dispatch arrangements allow, please contact me before purchasing and I will tell you what is possible. A faster or special delivery service may involve an additional charge, which will be agreed with you before purchase.

Collection in person from Monmouth may also be available by prior arrangement.

Your right to cancel a distance purchase

If you are purchasing as a consumer, you normally have the legal right to cancel a distance purchase without giving a reason.

For an artwork, the cancellation period ends 14 days after the day on which you, or a person you nominate other than the carrier, receives the artwork.

To exercise your right to cancel, you must tell me clearly that you wish to cancel before the cancellation period expires.

You may use the cancellation form provided at the bottom of this document, but you do not have to use it.

If you change your mind

After telling me that you wish to cancel, you must return the artwork without undue delay and no later than 14 days after notifying me of your cancellation.

If the price of the artwork included standard delivery, I will refund the full price you paid.

If delivery was charged separately, I will refund the price of the artwork together with the cost of the standard delivery service offered for your order.

If you chose a more expensive delivery option than my standard service, I am not required to refund the additional cost of that premium delivery option.

For a change-of-mind return, you are responsible for the cost of returning the artwork to me.

Please package the artwork carefully so that it is adequately protected in transit. Where possible, I recommend retaining and reusing the original protective packaging.

I recommend using a tracked return service and obtaining proof of postage.

You are entitled to handle and inspect the artwork as you reasonably would before deciding whether to keep an item bought in person. I may make a deduction from the refund if the value of the artwork has been reduced by handling beyond what is reasonably necessary to establish its nature and characteristics.

No cancellation or restocking fee is charged when you exercise your statutory right to cancel.

Refunds following a change-of-mind cancellation

I may withhold the refund until I have received the artwork back or, if earlier, until you provide evidence that you have sent the artwork back.

I will make the refund without undue delay and no later than 14 days after the day on which I receive the artwork back or, if earlier, the day on which you provide evidence that you have sent it back.

The refund will be made using the same payment method used for the original purchase unless we expressly agree otherwise. You will not be charged a fee for the refund.

If an artwork is damaged, faulty or not as described

It is my responsibility to supply goods that conform to the contract and meet your statutory consumer rights.

If your artwork arrives damaged, is faulty, is not as described or you believe there is another problem with it, please contact me as soon as reasonably possible at rod@rodedwards.art.

Where you are entitled to reject an artwork because it is damaged, faulty or not as described, I will refund the full amount you are legally entitled to receive.

This includes the purchase price and any outward delivery charges that must be refunded under consumer law. Unlike a change-of-mind return, I will also bear the reasonable cost of returning the artwork to me.

I may arrange the return with you directly or agree an appropriate return method with you.

If damage appears to have occurred during delivery, it is helpful if you retain the packaging and send photographs of the artwork and packaging so that I can investigate the damage with the carrier. This request does not restrict your statutory rights.

Your statutory rights under the Consumer Rights Act 2015 are not affected by these terms.

Copyright

Purchase of an original artwork transfers ownership of the physical artwork to you. Copyright and reproduction rights in the artwork remain with Rodney J. Edwards unless expressly agreed otherwise in writing.

Changes to these terms

The terms applying to your purchase are those provided or made available to you when you place your order. Any later change to these website terms will not retrospectively change the terms of an existing purchase without your agreement.

Law

These terms are governed by the laws of England and Wales. Nothing in these terms removes any mandatory consumer rights that apply to you in the part of the United Kingdom in which you live.
